Exposing the So-Called "Unconstitutionality Defense"

Text of Letter to the NYT: "In the event enough Republicans vote not to convict Trump on the grounds that it is unconstitutional to hold an impeachment trial of an ex-president, then the House Managers should move to stay the proceedings with the right to resume them should Trump be elected president in 2024. Given that impeachment is not a criminal proceeding so the doctrine of double-jeopardy would not apply, there would not be any legitimate basis for the Republicans to oppose such a motion. While legitimacy of position is not a hallmark of most Republican senators, their opposing such a motion would confirm that the supposed “unconstitutionality defense” they voted to uphold was a pure fabrication."
